Information and forms for additional ADR schemes are available on request. Post commencement forms for agreements, provisions and stipulations for use during the ADR process are also available on request.
CONTRACTUAL CLAUSES FOR DISPUTE RESOLUTION THROUGH IMAC If you wish to provide for mediation, arbitration or a combination thereof through IMAC, the following contractual clauses can be utilized. Mediation of Future Disputes “In the event of a dispute, claim or difference arising out of or in connection with this contract, including any question regarding its existence, validity or termination, the parties agree to enter into non binding mediation through IMAC under its Mediation Rules current at the date the dispute is referred to mediation.” Arbitration of Future Disputes “Any dispute claim or difference arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be determined through binding arbitration by IMAC under its Arbitration Rules current at the date of the reference. The governing substantive law of the contract shall be the law of [ ].” Combined Clauses for Future Disputes “In the event of a dispute, claim or difference arising out of or in connection with this contract, including any question regarding its existence, validity or termination, the parties agree to first enter into non binding mediation through IMAC under its Mediation Rules current at the date the dispute is referred to mediation.
