ALTERNATIVE DISPUTE RESOLUTION THROUGH IMAC AND ACI Mediation is well suited for resolving complex commercial disputes that would otherwise be determined through an expensive and lengthy litigation process. It is a private, informal, voluntary, confidential, flexible and non-binding process conducted through a third party neutral whose goal is to assist the parties in reaching an agreement acceptable to all parties. During this process, the mediator conducts private caucuses with each party, facilitates the structured exchange of views and information, identifies key issues and makes recommendations. Mediators do not impose their will or opinions on the parties. Due to the nature of the mediation process, the parties have the opportunity to fashion a resolution of their dispute that directly addresses their needs and interests, and which can include terms and provisions that could not be achieved through conventional litigation. When the parties cannot resolve their dispute amicably, either privately or through mediation, arbitration is a cost effective alternative to litigation and trial through the court system. It is a private process in which a dispute is submitted, by agreement of the parties, to a single arbitrator or a tribunal of arbitrators who render a decision that is binding on the parties. In contrast to the court system, the arbitration procedure is flexible in terms of time and offers less formal procedures. The arbitration hearing takes place in a private office and is conducted by an arbitrator or arbitrators in accordance with IMAC’s rules, subject to appropriate modifications by the parties.
